A probate attorney is a lawyer hired to represent a person in probate court to be appointed the manager of the assets of an estate. The estate manager is either called the estate executor (if the person is named as an executor within the decedent’s will) or the estate administrator (if the person appointed to manage the estate is not named as an executor in the will or when there is no will). Probate attorneys help to assist the estate administrator navigate the estate probate process. Many probate attorneys also assist with other legal matters, such as the drafting of wills and living trusts and/or advising on powers of attorney.
