CLIENT REVIEWS

"Excellent experience! I would recommend Mr. Davenport to anyone seeking an attorney to help with estates and probate situations. I was in Nebraska and he was in Texas handling my father's estate and it worked out great. Made a stressful situation of the death of my father a little easier."
-Robert S.

"Mr. Davenport was very prompt and efficient with the entire case on probate. He helped me through to get proper documents for financial obligations and requirements from the Judge at court. He walked me through what needed to be done. I am looking forward to Mr. Davenport's assistance with future legal needs and highly recommend him to anyone."
-Quinn M.

"Mr. Davenport prepared my Last Will and Testament which directs how my estate will be distributed at my death. Additionally, Mr. Davenport prepared other estate planning documents for me including a Durable Power of Attorney, a Texas Medical Power of Attorney, a Directive to Physicians and Family and Final Disposition Authorization and Instructions. Mr. Davenport was very knowledgeable about estate planning and he prepared the documents according to my wishes in a very timely manner."

Texas Wills and Estate Plans

The majority of Texas estate plans typically include a Last Will and Testament as well as a number of other financial and healthcare documents. An irrevocable or revocable trust also may be used to help avoid probate. In the event of incapacity, an estate plan also may help eliminate the need to appoint a guardian of the estate. Another consideration is who should be included in healthcare decision making. Every estate plan is unique, but everyone should have a valid Last Will and Testament. Estate planning does not have to be complex in order to be effective, but planning for the future should be Chess, not Checkers.

Estate Probate and Administration

The probate process is the legal method used for transferring assets and discharging debts of an estate. Many assets can be transferred without having to initiate a probate proceeding. Some common assets that can be transferred outside of probate include community property with right of survivorship, accounts that have a payable upon death beneficiary, life estates, certain annuities with a survivor’s benefit, as well as property that has been placed into a trust. These assets usually can be transferred by simply providing a copy of a death certificate to the appropriate fiduciary agency. However, there are other situations where assets cannot be transferred without an official legal proceeding that establishes the particular rights of inheritance for different types of property. Probate is usually necessary when a person dies without a will and/or has not made arrangements for what should happen to their property after their death. The type of probate required often depends on the nature and extent of the assets as well as the amount of debt involved.
